Warranty & Claims
All finishes, parts, and components of new furniture and merchandise (our “Products”) are warranted by Bellini Modern Living to you, the consumer, for one (1) year from the invoice date to be free from defective material and manufacturing defects only (“Defects”) under normal use as outlined herein and subject to the provisions, limitations, and exclusions contained in this Warranty (the “Warranty”). Under this Warranty, liability is limited to repairing the defective Product, replacing the defective Product, or supplying replacement parts to remedy the Defect. Bellini Modern Living’s first option will be to supply replacement parts; if this is not possible, then the defective Product may be replaced or repaired at our discretion. If minor repairs can correct the issue, Bellini may approve reasonable and customary labor rates prior to repair, in which case Bellini will reimburse you for repair costs upon receipt of a paid invoice for such repair. Bellini will not be responsible for the costs to transport defective Products to your place of purchase (the retailer) or return them to our facility in Toronto.

This Warranty provides coverage to the original purchaser only and is non-transferable under any circumstances. This Warranty applies to Products used in residential and non-residential settings as long as the Products were intended for such use at the time of sale. The Warranty is void if non-contract viable Products are placed in a commercial or non-residential setting. The Warranty is also void if any modifications, including re-upholstering, have been made by any dealer, trade partner, or other person.

This Warranty does not apply to any condition or damage that is not a Defect, including but not limited to damage resulting from neglect, misuse, abuse, accident, unreasonable or unintended strain or use, incorrect or inadequate maintenance or cleaning, or damage to or failure of finishes resulting from exposure to alcohol, water, fabric dye transfer, liquids, sunlight, household humidity, incorrect application of chemical treatments, or protective coatings. Any credit notes resulting from returns or damages must be used toward future orders within one (1) year of issue; unused credits will expire after this time.

Italian Sofa Frame Warranty
The frame of Italian sofas is covered for two (2) years from the invoice date under this Warranty. This extended coverage applies exclusively to the internal frame structure of Italian sofas and does not cover upholstery, cushions, stitching, leather, fabric, or other components of the sofa.

How to Make a Warranty Claim
All claims must be submitted within the applicable Warranty period. It is the consumer’s responsibility to contact the retailer (the place of purchase) immediately upon discovering a Defect and before contacting Bellini Modern Living. Private Consumers should not contact Bellini Modern Living directly unless instructed by their retailer.

When filing a claim, you must email service@bellinimodernliving.com with the following information:

  • A full description of the Defect

  • Proof of the issue with clear images and/or video

  • A full photo of the item as well as close-ups of the damage

  • The purchase order number (P.O.#)

  • The date you received the Product

All damage claims must be made within 3-4 days of receiving the item. Shipping damage claims must be directed to the shipping company immediately.

Limitation of Liability
THIS LIMITED WARRANTY IS EXCLUSIVE AND CONTAINS ALL EXPRESS AND IMPLIED WARRANTY RIGHTS OF THE PURCHASER. BELLINI MODERN LIVING MAKES NO OTHER WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE THAT EXCEED THE OBLIGATIONS OR TIME LIMITS STATED IN THIS WARRANTY ARE HEREBY DISCLAIMED BY BELLINI MODERN LIVING AND EXCLUDED FROM THIS WARRANTY. THE PURCHASER AND BELLINI MODERN LIVING EXPRESSLY AGREE THAT THE SOLE REMEDY OF THE PURCHASER SHALL BE REPLACEMENT OR REPAIR OF THE DEFECTIVE PRODUCT OR COMPONENT THEREOF. IN NO EVENT SHALL BELLINI MODERN LIVING BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS RELATED TO PROPERTY OTHER THAN THE PRODUCTS, PERSONAL INJURY, LOSS OF USE, LOSS OF TIME, INCONVENIENCE, OR OTHER ECONOMIC LOSS.

Payment
All orders are to be prepaid in advance of being shipped unless terms have been established. Terms are never given on an opening order and are only granted after several orders and thorough credit checks.

(IMAP) Internet Minimum Advertised Price Policy

Each customer remains free to establish its own resale prices. However, a customer may not advertise or otherwise promote Bellini products over the Internet at a net price (final price paid net of any discounts, coupons, promotions) that is less than the Internet Minimum Advertised Price (IMAP) established by Bellini.
